Terms and Conditions - Purchase and Complaints Policy

Dear Customers, Welcome to www.jozanek.cz online store. Before you start shopping, please read the terms and conditions below. As a buyer, by confirming your order you agree to the terms and conditions of purchase below.

This online shop is operated by: Jana Gebauerová Havelková, ID: 76130037, VAT: CZ8351152909, registered office Osada Dukla 250, 415 01 Újezdeček.

Our establishment is located at Komenského 498/2, 417 31 Novosedlice. There is no shop at this address. The goods can only be picked up in person, not collected or tried on, after agreement and payment in advance.

1. Purchase order

To search for the desired product, the buyer can use the division of products by category in the top menu or search e.g. by product name in the field with a magnifying glass (above the category bar).
Information about individual items is provided in two levels - preview and detail. The preview is designed for easier and faster orientation in the offer, the detail is used to get more information about the product and to add it to the cart. The detail can be accessed by clicking on the image. For most items you can choose from several sizes. You can select the desired size by marking it and clicking on the ADD TO CART button. If you want to order more pieces, change the number before clicking the ADD TO CART button.

You can view the items in your cart at any time by clicking on the cart icon on the top right. You can continue shopping by simply clicking on a category from the left menu. To complete your order, click on the CONTINUE SHIPPING button below the displayed status of your cart. Here you will select your shipping and payment method and then click on the CHECK OUT DELIVERY DATA button to continue to the page where you will fill in your contact, billing and delivery information. Then you need to check the option "I agree to the terms and conditions" and complete the order by pressing the ORDER BINDING FOR PAYMENT button. This is followed by a possible switch to the payment gateway system if you have chosen the online payment method. You will receive information about the receipt of your order with a recapitulation of the order in the email you provided.

2. Cancellation (order cancellation)

The buyer can cancel his/her order within 15 minutes after the order has been sent by e-mail to jozanek@jozanek.cz. The subject line of the email must include the word CANCELLATION. If the Buyer cancels the order later than the 15 minutes deadline, the Seller will accept such cancellation only after prior agreement with the Buyer and is not obliged to accept it in advance - the goods may have already been shipped. The Seller reserves the right to cancel the order or part of it in cases where the ordered goods are no longer in production and for other reasons. In such cases, the buyer will be contacted immediately by the seller and a further procedure will be agreed with him. If the buyer has already paid the purchase price or part of it, this amount will be transferred back to his account or address as soon as possible.

3. Payment Terms

All prices quoted in this online shop are contractual and final. The buyer has the option to choose from several payment methods, depending on the country to which the goods are ordered.

If the buyer chooses to pay in advance to the seller's account, he/she will make the payment within 3 days of the sending of the payment request, i.e. the payment documents including the variable symbol. If the Seller does not have the payment credited to the account within 5 days of sending the request, the Seller will cancel the order unless otherwise agreed in writing, i.e. by email, with the Buyer.

4. Delivery terms

We ship goods that are in stock no later than the next business day after receipt of the order (confirmed online payment, cash on delivery), or after receipt of payment on account (payment in advance or online payment that is not immediately confirmed by the payment gateway-. there may be a delay of up to 24 hours).

If you are ordering an item that is not in stock on the e-shop, but has an availability of 14 days from ordering, the entire order will be sent to you within this period, even if the other items are in stock. We process orders all at once, not in parts. If you are interested in sending the goods in stock immediately, please make a separate order for it.

If it is not possible to meet the despatch date of the goods in accordance with these terms and conditions, we will inform you immediately (no later than the next working day after receipt of your order) to agree a further course of action.

The buyer is obliged to inspect the packaging of the parcel by sight upon receipt. In the event of visible damage, a damage report must be made with the carrier (at the driver or at the point of delivery) and the parcel must not be collected! If the buyer collects a visibly damaged parcel without making a damage report and without checking the contents of the parcel before collecting it, the buyer cannot claim the damage back.

5. Returning goods

If the buyer is not satisfied with the goods purchased from this online store, he/she is entitled to return the goods, but no later than 14 days after delivery, by sending them to JOŽÁNEK - Jana Gebauerová Havelková, Komenského 498/2, 417 31 Novosedlice, Czech Republic.

The costs of returning the goods are borne by the buyer. The buyer has the option to use the return shipment of the mail order company (code: 91745708) for the return of the goods. This fee will be deducted from the payment for the returned goods.

The goods must be returned undamaged, unworn and unwashed, they must not smell of sweat, perfume, household odours, odours from the wardrobe, etc. ( !!! )

The goods must be accompanied by a copy of the proof of purchase or at least the invoice number and account number for refund. After the return of the goods, payment will be sent to the buyer by bank transfer to the buyer's account within 7 working days from the date of return of the goods.

Exchange of goods for goods of the same value is free of charge. For the purpose of exchange, it is also possible to use the free return shipment service (code: 91745708).

6. Returns Policy

The buyer is obliged to inspect the packaging of the parcel by sight upon receipt. In the event of visible damage, a damage report must be drawn up with the carrier (at the driver or at the point of delivery) and the parcel must not be accepted! If the buyer accepts a visibly damaged parcel without drawing up a damage report and checking the contents of the parcel before accepting it, he/she can no longer claim a loss.

The warranty for consumer goods is 24 months and is governed by the relevant provisions of the Civil Code. The warranty period begins on the date of receipt of the goods by the buyer. If a defect occurs in the purchased goods that is covered by the warranty (i.e. it is a defect as such, not wear and tear due to normal use, which is not covered by the warranty!!!), the buyer shall claim by sending the defective goods to JOŽÁNEK - Jana Gebauerová Havelková, Komenského 498/2, 417 31 Novosedlice. In the notification of defects, the buyer shall state his name, address, e-mail, telephone number, the designation of the goods claimed, the date of purchase and a description of the defect.

For successful settlement of the complaint, the buyer shall provide proof of purchase of the goods.

Depending on the type of defects, in accordance with the legislation in force in the Czech Republic, a legitimate complaint will be resolved by repairing, replacing the goods or refunding the purchase price paid. The warranty provided does not apply in particular to wear and tear caused by normal use, defects caused by improper handling or storage of the product. Furthermore, the guarantee does not cover defects caused by using the product in contravention of the instructions (washing symbols), negligent maintenance or using the product for a purpose other than that for which it is intended. In the event of a conflict with the purchase contract, i.e. if the goods are not in accordance with the purchase contract, the seller is governed by the provisions of Section 616 of the Civil Code.

If the buyer claims the product more than 6 months after its purchase due to a defect that has become apparent only during its use (e.g. broken zipper) and the claim is not recognized as justified by the seller, i.e. the defect is not evaluated as a (hidden) defect of the product, but as its wear and tear, the buyer has the option to turn to an independent forensic expert for the preparation of an opinion. According to the law, after the expiry of the 6-month period from the purchase of the goods, the burden of proof is on the buyer. The seller is willing to take the expert's opinion into account and reconsider his decision to accept the claim if necessary.

7. Data protection and information on the processing of personal data

The operator of the online shop www.jozanek.cz, declares that all personal data is considered strictly confidential and is treated in accordance with Act No. 101/2000 Coll. on the protection of personal data and Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data ("GDPR").

We process your personal data solely for the purpose of fulfilling the purchase contract (order processing, invoicing). We keep records of this data, which is necessary for the fulfilment of our legal obligations, especially for tax administration purposes, but also for example for claims and after-sales service, for a maximum period of 10 years. During this period you have the right to access your personal data, the right to rectification of your personal data, the right to an explanation regarding the processing of your personal data and the right to request the erasure of your personal data

In no case do we provide your personal data to a third party, with the exception of your completed delivery address, e-mail and tlf. number, which we provide to the shipping company for the purpose of delivery of goods. Neither will your personal data (nor your e-mail) be used for any marketing actions on our part, such as newsletters, etc. By registering on our e-shop, you do not give your consent to the processing of your personal data. Registration is only for the possibility of logging in to your account in our e-shop and taking advantage of its benefits (overview of orders, invoices, favourite goods, pre-filled data for further orders, etc.). In no case will your data used during registration be used for other purposes or provided to a third party.
